        Thanks! that’s an interesting idea! At wolf’s someone suggested removing the ground about 3 inches down and getting new topsoil. hubby and i are weighing choices. there are 2 tomato plants and 2 plants that survived and look okay…so do we want to try and save them or just bag the whole thing this year? we’re still mulling it over…lol

        Flooding would be good except the 48 marigolds (which i planted in the cinder blocks around the outside of the garden –with no fertilizer–)would be ruined as well. sigh…so many things to consider.

  1. Filly, do you know and understand what this is about? Two candidates are being sued because they are running in NE elections but have no intention to serve if they win. why run then? I’m missing something, i think.

    LINCOLN — A former Republican state lawmaker and an unsuccessful GOP candidate for Legislature sent complaints this week to Nebraska Attorney General Mike Hilgers asking him to look into the U.S. Senate candidacies of Democrat Cindy Burbank and Legal Marijuana NOW nominee Mike Marvin over allegations that neither of them intends to serve.

    The complaints, obtained by the Examiner and verified by the people filing them, allege that Marvin and Burbank aren’t “good faith” candidates under a requirement in state law that candidates who run actually seek the office sought, and that the two targeted candidates opposing Republican U.S. Sen. Pete Ricketts made “false” statements under “oath or affirmation” when they filed to run. 

    The requests argue separately that the candidates may have broken Nebraska law related to election falsification, perjury or encouraging perjury or making a false sworn statement. The complaint about Marvin comes from Derek Schwartz, a La Vista police officer who ran unsuccessfully this spring for the Nebraska Legislature in District 18. The complaint about Burbank came from Lydia Brasch, a former state senator from West Point, Nebraska, who served from 2011 to 2019.  

    “I believe election integrity in Nebraska, not just this cycle, but in all cycles going forward is a paramount priority, and that manipulation of Nebraska’s election laws through strategic withdrawals and bad-faith candidacies is an unlawful practice that authorities should take steps to stop,” Brasch wrote in her complaint. 

     Marvin and Burbank didn’t immediately respond to requests for comment Thursday evening. 

    The complaints largely echo arguments made by Nebraska Secretary of State Bob Evnen when he briefly removed Burbank from the ballot. She sued successfully to get back on, partly because Evnen missed a deadline for raising his objection.

    The requests also echo concerns about Burbank raised to Evnen by the Nebraska Republican Party in March. The NEGOP had argued Burbank was not a “good-faith” candidate. Its complaint argued she had no intention of serving if elected. 

    Brandon J. Johnson, an assistant professor at the University of Nebraska-Lincoln College of Law who focuses on election law, said the complaints, in his eyes, seem to lack merit. But he said he can’t predict how a court might rule if a lawsuit comes. 

    “In terms of what the oath requires, right, is a willingness to serve if elected, which doesn’t seem to require running an active campaign … you’d probably run into some significant First Amendment problems if you required a primary candidate to run, no matter what,” Johnson said.  

    Burbank’s attorneys made similar arguments in court this spring. 

    The oath that candidates sign when they file to run says, “I hereby swear that I will abide by the laws of the State of Nebraska regarding the results of the primary and general elections, that I am a registered voter and qualified to be elected, and that I will serve if elected.”

    Johnson, the law professor, said the complaints appear to misinterpret some state statutes. No action has yet been taken by the attorney general. The Attorney General’s Office had no immediate comment on the requests Thursday evening.

    Former Nebraska Attorney General Doug Peterson, a Republican who has argued election cases, said by text Thursday that he “suspects our courts are not excited about being brought into political lawsuits, [but] in order to maintain the integrity of our electoral system it is imperative that the alleged facts be heard and decided by our judicial system.” 

    The latest complaints came days after Hilgers confirmed to the Examiner that the Secretary of State’s Office in Lincoln has reached out to him for guidance on whether Evnen, the state’s top election official, can keep Burbank on the November ballot once she asks to be removed, which she could do after the state formally certifies the election on June 8. 

    The requests are the latest in months of back and forth over who should reach the November ballot between backers of Ricketts and nonpartisan U.S. Senate candidate Dan Osborn, after a primary election rife with flying allegations of candidates “planted” to help each of them, which all involved campaigns have denied. 

    Said Johnson, the professor: “This is all politics … and trying to turn it into a legal issue is one of the things that’s troubling about our current state of politics.”

  3. Just The News: “Despite the renewed popularity of smoking in Hollywood, the percentage of U.S. adults who smoke tobacco hit a new record low in 2025, just 9%, according to “early release” estimates from the Centers for Disease Control and Prevention’s 2025 National Health Interview Survey.

    It fell from 10% in 2024, while e-cigarette use leveled off at around 7% in 2025 after “inching up among adults” in prior years, the Associated Press said. 

    The survey findings are based on responses from more than 24,000 adults, who were deemed current smokers if they had “at least 100 cigarettes in a lifetime” and currently smoke “every day or some days.”

    Total tobacco use stands at 19%, however, according to a March study published in the New England Journal of Medicine Evidence, based on 2023–2024 National Health Interview Survey data with more than 60,000 adult participants. The researchers included e-cigarettes because the government regulates them as tobacco despite containing no tobacco.”

    Senate Bill 73 prevents law enforcement agencies and officers from conducting certain activities that the governor’s office described as efforts to undermine or disrupt elections.

    “Just six days out from the election, we thought this was a timely bill,” Newsom said during a press conference held in Sacramento on Thursday. “I just want to express gratitude to our two senators and assemblywoman for their outstanding work to address the anxiety that has been expressed almost universally about what’s going on with fair and free elections.”

    Senate Bill 73, which was authored by Sen. Sabrina Cervantes, D-Riverside, and Sen. Tom Umberg, D-Santa Ana, provides guidance to county elections officials and election site managers about how to handle requests from law enforcement agencies to access election areas and ballots. It also prevents law enforcement officers from interfering with the work of election workers, prevents election observers from challenging a signature on a vote-by-mail ballot and keeps law enforcement from taking or modifying ballots and voting technology, according to a legislative analysis.

    “Right now, California is standing with courage, standing with urgency, to protect voters’ rights to cast a ballot free from intimidation or interference,” Cervantes said during the Thursday press conference. “We’ve seen an incident in my own home county of Riverside where ballots were seized and the chain of custody was broken. That is against the law.”

    According to the bill analysis, a group in Southern California’s Riverside County raised alarm earlier this year over a discrepancy in the number of ballots cast in the November 2025 special election. A difference of nearly 46,000 ballots was disputed between numbers reported by the Riverside County Registrar of Voters from the actual number cast. The Riverside County Sheriff’s Office obtained a warrant from the Riverside Superior Court to seize 1,000 boxes of ballots and ballot materials. In April, the California Supreme Court ordered the sheriff’s office to halt its investigation…..”

    To wake up and learn that horses were stabbed in their stalls during the NBHA (National Barrel Horse Association) Las Vegas Show is beyond heartbreaking. One horse reportedly suffered catastrophic injuries, while others were also injured in what appears to have been an intentional act of violence. Stabbing several horses and slitting one’s throat.

    These horses are not equipment. They are not entries. They are not numbers on a draw sheet. They are athletes, partners, family members, and for many of us, they represent years of work, sacrifice, dedication, and love.

    To think that horses standing quietly in their stalls could become victims of an intentional act of violence is something that is difficult to comprehend. Every horse owner knows the feeling of walking into a barn and expecting to see your horse safe and waiting for you. No one should ever have to fear finding anything different.

    My heart breaks for the owners, trainers, grooms, family members, and everyone directly affected by this tragedy. I cannot imagine the fear, devastation, and helplessness they experienced.

    I also want to recognize the quick response from South Point Security, law enforcement, veterinarians, event staff, and everyone involved. South Point has always been one of the facilities where I’ve felt safe showing and walking through the barns. The barns are typically well secured and not easily accessible to the general public. The fact that authorities were able to respond quickly and make an arrest speaks volumes about how seriously this situation was handled.

    Unfortunately, every industry and every walk of life has its bad apples. Most horse people are some of the most caring, hardworking, animal-loving individuals you’ll ever meet. That’s what makes something like this so difficult to understand.

    Today isn’t about competition, prize money, or who won. It’s about innocent horses and the people who love them.

    Hug your horses a little tighter tonight. 💔🐴

    Suspect Identity: 17 Year Old Emily Grace (competing as an event participant) is formally in custody.

    Charges Filed: She is currently booked under multiple counts of felony animal cruelty and malicious treatment of livestock.

    Bail Status: She remains held at the Clark County Detention Center awaiting an initial arraignment hearing scheduled for early next week. No bail has been granted at this time due to the severity of the incident.

    Health Status of Targeted Horses: On-site veterinarian teams and community updates have provided a clearer picture of the three affected animals:

    Saaul Good (“Sully”): Hailey Krahenbuhl’s champion gelding is out of immediate danger. The veterinary staff successfully cleaned and sutured deep blade lacerations on his flank and shoulder. He is stable, responsive, and receiving intensive antibiotic therapy to prevent infection.

    Second Affected Horse: A mare belonging to a regional circuit rider underwent emergency surgery this morning to repair muscle tissue damage. Veterinarians report that her vitals are stable, and she is resting comfortably in a secured quarantine stall on-site.

    Third Affected Horse: The final victim sustained minor superficial cuts. This horse was treated on the scene without requiring major surgery and has already been cleared to return home with its owners.”

        1. My a-Mom used to make 6 Layer Dinner with pot roast leftovers: meat, potatoes, onions, carrots, and rice, topped with a can of chopped tomatoes, salt & pepper. Bake in the oven long enough to heat thru – longer if you have to use some raw ingredients. It’s really good!

    Why Doesn’t the FBI and DHS stop this violent, organized, national activity?

    Don’t make it complicated. Just look at things as they are, as they present themselves to be, and ask the most obvious questions.

    “Domestic Tranquility?” Why are violence and chaos permitted?

    How can a group within America openly threaten police, use violence against police, throw Molotov cocktails, bricks and explosive fireworks at police. Use batons, shields, bats and physical violence against police and federal law enforcement; destroy vehicles, set cars on fire, destroy property, trash and block the streets and create chaos, completely without consequence?

    It doesn’t matter where it is happening, that’s irrelevant. Think plainly and simply.

    How does any individual or group get to do this without being arrested?

    It doesn’t make sense, unless….
    …. Unless…. The group conducting the violence cannot be arrested.

    Day after day; night after night, in most major metropolitan areas around the nation, the group known as “Antifa” operate with impunity. They are organized; they are funded; they communicate locally, regionally and nationally. They mobilize in designated and coordinated areas of operation, and they are exceptionally violent and dangerous.

    So how is it they can operate?

    They build encampments outside federal facilities and openly fight with federal officials and law enforcement. Yet, nothing is done. Why not?

    If the FBI did not support Antifa, quite simply Antifa would not exist. They are right there, highly visible, doing illegal things on camera, repeatedly, all over the country, and the FBI doesn’t lift a finger to stop them. Why?

    The only thing that makes sense is that the FBI wants this activity to take place.

    If they did not want it to take place, they would stop it and arrest the lawbreakers who are attacking federal buildings and officers. 

    The visuals of trashed streets, barricades, smoke bombs, riots, semi-frequent baton clashes in the streets, etc. etc. must serve some purpose for the FBI and DHS or they would stop it.

    This is not misdemeanor behavior.

    Arrest the participants and put them into federal prisons. This is not complicated.

    The FBI and DHS support Antifa. If they did not support them, the FBI and DHS would stop them.

  18. The Orioles are going thru so much jelly that I had to order another case this morning. I’ve got 5 – 32 oz. jars left out of the first 12-jar case – I’m going thru almost a jar a day!!! That includes all the finches, too, of course and no, I’m NOT counting the squirrel! Grrrrr……

        1. in fact there is one larger female grosbeak–she is the QUEEN of the jelly. if she comes to the feeder–everyone gets out of here way. and if any of the males come after her, she lashes out with her beak. everyone runs!
