The Trump administration reached a settlement in principle with Babbitt’s family earlier this month, but the amount was not previously reported. Babbitt was a 36-year-old Air Force veteran who was fatally shot by a U.S. Capitol police officer during the riot, while apparently trying to climb through a broken window leading to the House Speaker’s Lobby in the Capitol Building.
Babbitt’s family filed the $30 million lawsuit last year, accusing U.S. Capitol Lt. Michael Byrd of being negligent in his use of force and firearm during the riot, and claimed he was not dressed in uniform at the time of the shooting.
Outgoing U.S. Capitol Police Chief Tom Manger confirmed the settlement to CNN, and expressed his concern over the agreement. Manger also said he was notified of the settlement amount a “few weeks ago.”
“I was extremely disappointed, and I disagreed with the Department of Justice’s decision to settle this lawsuit,” he said. “In 2021, the DOJ investigation determined no wrongdoing by police. This settlement sends a chilling message to law enforcement nationwide, especially to those with a protective mission like ours.”
The Justice Department has not commented on the reported settlement so far. It is not clear when the deal will be finalized.”

President Donald Trump signed an executive order earlier this month that formally established the federal program, which also gave undocumented migrants free flights out of the country. The program is part of the Trump administration’s efforts to curb illegal immigration and deport people already in the U.S. illegally.
The department said the flight carried 64 Colombian and Honduran migrants back to their home countries. “All participants were offered the same benefits as any illegal alien who self-deports using the CBP Home App,” DHS said in a news release. “They received travel assistance, a $1,000 stipend, and preserved the possibility they could one day return to the United States legally.”
The program allows migrants to apply for self-deportation through the Customs and Border Patrol app, and gives the migrants three weeks to finalize their affairs before leaving the country.
“If you are here illegally, use the CBP Home App to take control of your departure and receive financial support to return home,” Homeland Security Secretary Kristi Noem said in a statement. “If you don’t, you will be subjected to fines, arrest, deportation and will never be allowed to return.”
