Poisoning of the Treaty Oak

Although over a quarter of a century has gone by, the bitter memory of the Treaty Oak’s poisoning still lingers in the minds of many Texans. Few recall, however, the dark motives of the man convicted of the crime.

The Treaty Oak is the lone surviving member of the Council Oaks, a grove where folklore holds that Stephen F. Austin met with Comanche and Tonkawa tribes to negotiate the first boundary treaty of Texas. The 600-year-old live oak is a belove Austin landmark. Before the poisoning, its branches spread some 130-feet wide.

John Giedraitis, at that time the arborist for the City of Austin, discovered dead grass under the tree in spring, 1989. After heavy rains caused the poison to penetrate the oak, leaves yellowed and sailed to the ground. Something was terribly wrong. Soon the malevolent cause of the tree’s illness was discovered, a revelation that shocked the Lone Star State.

When news of the poisoning spread throughout Austin, residents were outraged. The tree was a treasured part of the region’s history: Before European-Americans settled the land around it, the tree was revered in Tejas, Apache, and Comanche culture. A plaque beneath the site tells the (unsubstantiated) story of Texas settler Stephen F. Austin negotiating a border treaty with Native Americans on that very spot in the 1830s.

2012 timeframe

In an attempt to save the dying tree’s life, the city launched a full-blown recovery campaign. The contaminated soil was replaced with fresh dirt and the damaged roots were treated with sugar. A sprinkler system was installed in Treaty Oak Park to provide the tree a steady supply of revitalizing spring water. Other efforts were less practical: a Dallas-based psychic named Sharon Capehart tried healing the tree by transferring energy into it. (In the process, she allegedly discovered that its spirit had once belonged to an ancient Egyptian woman named Alexandria.) Without any supposed psychic gifts or tree expertise to offer, some Austin citizens responded with good vibes.

Texans from far and wide arrived to pay their respects to the dying tree. Around its thick trunk, they left notes and gifts, as well as prayers for the tree’s recovery. The experts were unanimous: none of them believed there was any hope for the Treaty Oak. Billionaire Ross Perot sent Austin a blank check. The city would spend $250,000 in an attempt to save the tree, using radical, desperate methods.

As the public processed the shock and grief, the Austin police worked to nab the perpetrator. On June 29, 1989—a few months after the crime had been committed—they arrested their primary suspect: a 45-year-old local named Paul Stedman Cullen. He was convicted on a second-degree criminal mischief charge nearly a year later. His motive?

Cullen poisoned the tree as part of a mystic ritual. “Prosecutors said he used the herbicide in an occult ritual to kill his love for his counselor at a methadone clinic, protect her from another man, and pay back the state for outdoor work he was forced to do while he was in prison,” The New York Times reported in 1990.

Before pouring the Velpar on the oak’s roots, Cullen had placed objects that belonged to his counselor in a circle around the trunk. He told an acquaintance that every time he passed the tree and saw it dying he would “see his love for the counselor dying.” The jury had the option to sentence him to life in prison, but in the end they settled on a sentence of nine years (which he served a third of) and a $1000 fine.

Witness Cindy Blanco testified that Cullen owned books on witchcraft and that he’d told her he had placed items belonging to the counselor around the oak’s roots before pouring the herbicide. When Cullen drove past the dying tree, Blanco claimed, it was as though he were watching his own unrequited love slowly perishing.

Cullen maintained his innocence and claimed the media was setting him up. His attorney made the case that Cullen had lied to Blanco in an attempt to appear impressive. The defendant faced the stark possibility of a life sentence.

The jury faced a difficult decision. They understood that a man’s life is worth more than any tree, even if the man in question is a criminal. Yet at the same time, the jury acknowledged a serious and disturbing crime had been committed and justice must be served. In May 1990, the jury gave Cullen a nine-year sentence and a fine of $1,000. He would serve only three years.

Perhaps prayers are stronger than black magic. In the end, the Treaty Oak survived. Though now a third of its original size, the oak is going strong and managed to produce acorns in 1997 for the first time since the poisoning. The Treaty Oak outlived Cullen, who passed away in 2001 at the age of only 57.

    The lawsuit challenged “Isolation and Quarantine Procedures” Rule 2.13 (10 NYCRR 2.13), which allowed New York governor Kathy Hochul to use the state Department of Health to issue regulations allowing health officials to involuntarily quarantine and detain people diagnosed or suspected of being exposed to a communicable disease for indefinite periods of time, depriving them of freedom, due process, and property rights, all while avoiding legislative oversight.

    Acting justice of the Supreme Court Ronald D. Ploetz ruled on July 8 that Rule 2.13 violates New York State law and is thus null, void, and unenforceable. He said that the Executive Branch had infringed on separation of powers, trampled on the constitutional due process rights of citizens, and ignored existing state law governing isolation and quarantine for serious contagious diseases.

    Involuntary quarantine had in fact been considered by the über-progressive state Legislature and decisively rejected. The proposal for involuntary quarantine dates back to 2015, when Democrat state assemblyman Nicholas Perry introduced a bill to allow the “removal and detention of cases, contacts and carriers” by the governor or surrogates. Rule 2.13’s provisions closely parallel Perry’s failed bill. Perry’s bill was toxic; it had no co-sponsors and no companion bill in the state Senate, failed to make it out of the Health Committee, was publicly denounced by the Health Committee’s chairman (a Democrat), and was withdrawn in December 2021 just before Perry resigned to become ambassador to Jamaica.

    The unusual nature of the rebuke was noted in an amicus brief filed by minority leader pro tempore Andrew Goodell, the Assembly’s second highest-ranking Republican. “This was an extraordinary repudiation of the bill, and a strong indication that the State Legislature had absolutely no desire to implement legislation that would authorize the involuntary confinement of people with suspected cases of an infectious disease without any due process.”

    Nevertheless, in the absence of legislative action, Rule 2.13 was adopted in March 2020 under the Cuomo administration and periodically renewed by Governors Cuomo and Hochul, most recently in April 2022. The Department of Health acknowledged that it wanted to make Rule 2.13 permanent.

    I understand, and approve of, knowing our history and appreciating it. However, that much effort and expense for one tree??? Seriously? Personally, I think that’s a bit much but that’s just me……

Big whoop! Is every single location around the country where a treaty was signed honored in such a manner? Nope.

              1. Yes, you’re right – I am in a “mood.” Feeling kind of defeated today – caught betwixt and between this morning.

                No doubt the treaty was critical to many people but who is to say that waaaay back when, in the early 1800’s, some treaty wasn’t signed with members of the Ponca Tribe right here on this property? No-one really knows everything that’s happened in the past. And, now that I think about it, it kind of bugs me the way people seem to want to worship inanimate, temporary objects. Maybe that’s why this kind of irks me. Seems such a waste to me and somehow hypocritical – worship this silly tree, meanwhile your country is falling down around your fricking ears!

  10. Good morning y’all! Had to come back to work to relax from my vacation! 😂 We got a lot done though and still have little things to do every night after work. Had a good anniversary dinner the night before our anniversary. We worked all Friday, our anniversary, but got a lot accomplished. Pushed myself hard that day working outside and almost got heat sick. It was well worth using out vacation for working, but man am I tired. Hoping for a quiet day at work today.

    Immediate quiet acceptance of the huge risk in using private cars for public transit from either the auto insurance companies or 50 state regulatory agencies
    Central registration and phone tracking apps required to book an Uber, drive an Uber, and to process the payments.
    A clone was spun off (Lyft) to create the illusion of choice.

    The ability to hail a cab, go where you want and pay cash was way too big a hole in the agenda that had to be closed.

    Last night The Gateway Pundit posted an URGENT ALERT on social media platforms GETTR, Telegram and Truth Social of a HUGE breaking report this morning that should take down corrupt FBI Chief Chris Wray.

    This morning TGP contributor Cara Castronuova released whistleblower documents, text messages and audio transcripts of FBI informant James Knowles’s communications with his FBI handlers on January 6 exonerating Trump supporters and the Proud Boys of any conspiracy or planning to storm the US Capitol, to enter the US Capitol, or to overthrow official proceedings.
    IT DID NOT HAPPEN as we all know.

    The 100 acre, $84 million luxury campus of the American Hebrew Academy in Greensboro, North Carolina, site of the Biden administration’s five-year lease for a new camp for illegal alien migrant children, is being backed by a communist Chinese company, Puxin Limited, that loaned the school $26 million dollars in 2019 and continues to be a lender to this day. Top ranking academy board members were replaced by Chinese figures after the 2019 loan, according to reports. Two months ago the New York Stock Exchange suspended trading in Puxin and moved to delist the firm.

    A September 19, 2019 press release by Puxin Limited announced the loan.

    BEIJING, Sept. 19, 2019 /PRNewswire/ — Puxin Limited (NYSE: NEW) (“Puxin” or the “Company”), a successful consolidator of the after-school education industry in China, today announced that it has entered into a loan agreement, deed of trust note and other ancillary documents with American Hebrew Academy, Inc. (“AHA”), a North Carolina non-for-profit corporation, pursuant to which Puxin extended a loan in a principal amount of US$26 million to AHA to fund its operations of an international college prep boarding school in North Carolina, the United States. The loan bears an interest rate of 18.0% per annum and becomes due on September 6, 2020. The loan is secured by AHA’s interest in certain real property located in North Carolina.

    “The American Hebrew Academy has deep Chinese connections, according to records uncovered by Judicial Watch. Its president, vice president and treasurer are Ni Zhang, Shong Gao, and Wei Yang. A few months after closing in the fall of 2019, the school took out a $26 million mortgage from Puxin, a Chinese education company. It planned to open under a new name, but never did. The money HHS is paying in rent will likely be used to pay back the Chinese company.”

    WFMY-TV reported at the time in 2019 the Puxin deal involved more than a loan:

    Public records available with the Guilford County Register of Deeds show that on Monday, September 9, American Hebrew Academy (AHA) transferred financial liability of its 100-acre property in Greensboro NC, to Puxin Limited, a publicly-traded Beijing-based firm. The documents were prepared in Orange County and signed an notarized by a Durham County Notary Public on September 6th.

    Puxin Limited is a Chinese K-12 after-school educational services provider based in Beijing. The Company offers study-abroad tutoring programs that help students to prepare for admission tests and applications for top schools, universities, and graduate programs. The documents also showed Puxin entered a lease agreement with AHA and the Deed of Trust amount of $26 million.

    After securing the loan from Puxin, AHA went through a similar restructuring and rebranding process. Ditching the religious aspect, it renamed itself AHA International School — a secular college preparatory high school geared toward international students. It announced its anticipated reopening for the 2020-21 year.

    A source familiar with the transition rebukes claims that Puxin’s role was strictly financial in nature. Puxin was deeply involved in the rebranding efforts and may have even pushed for the school to reserve 1/3 of its future student population for Chinese students.

    Just as Puxin issued the loan, 8 AHA board members either stepped down or were removed.

    Ni Zhang, Shong Gao, and Wei Yang stepped in to serve in the highest ranking roles.

    The school’s registered agent on its business registration documents changed from former CEO Glenn Drew to a woman named Qinghua Zhao.

    Puxin’s financial records to its shareholders indicate the company’s income from the interest-bearing loan increased drastically from 2018 to 2019 as well as from 2019 to 2020 and attributed the growth to AHA.

    William Scarborough, who oversees AHA’s property and represents the board did not respond to requests for the names of current board members but did confirm Puxin refinanced the school’s debt in 2019 when it was the verge of default. He also confirmed that Puxin remains a lender to the school.

    North Carolina’s eight Republican Congressmen, Richard Hudson, Ted Budd, Madison Cawthorn, Patrick McHenry, Virginia Foxx, Dan Bishop, Richard Rouzer and Gregory Murphy have been raising a stink about the Biden administration’s plans to house illegal alien children at the luxury campus.

    The Washington Examiner reported Friday the Biden administration signed a no-bid contract worth $177 million with New York-based Deployed Resources to manage up to 1,100 illegal alien children and underage teenagers in the lap of luxury at the academy.
